The New Law – In Brief

A new amendment to the Danish Working Time Act was passed on January 23, 2024, and took effect on July 1, 2024. The amendment makes it mandatory for Danish employers to implement a time-tracking system that is “objective, reliable, and accessible.”

The purpose of the new time tracking requirement is to ensure employees’ rights are upheld and that employers comply with working time regulations. Additionally, it aims to help employers accurately document employees’ working hours and gain a clear overview.

What Needs to be Tracked?

Two main things are subject to mandatory tracking:

  1. Employees must be able to log their total daily working hours (there is no requirement to specify the time intervals).
  2. Employees can choose to log only deviations from their agreed working hours.

Furthermore, the new law requires that employees must have access to their records in the time tracking system. Employers are also required to store the recorded data for five years after the end of the period, which constitutes the calculation of the employee’s total weekly working time. This requirement also applies after an employee’s resignation.

Choosing an online system for this purpose can be a significant advantage, even though using something as simple as an Excel sheet would technically comply with the law.

Who Must Track?

As a general rule, the law applies to all employees, including salaried workers, hourly workers, and employees covered by various collective agreements.

However, a specific group is exempt from the new tracking requirement. This group, referred to as Self-Managers, includes senior management and employees who organize and manage their working time independently and make their own decisions.
